Birth injury
Mental and motor delays in development or cerebral palsy may occur as the result of preventable injuries to the brain in the birthing process or immediately after delivery. For example, a lack of sufficient oxygen to the brain at this time can result in permanent brain damage. The overriding issue is whether the injury could and should have been prevented by the professional caregivers who include the obstetrician, nurses and pediatricians or neonatologists. Read more about the causes of preventable birth injuries.
There are times when medical professionals or hospital caregivers do not follow the well-known, accepted practices that would detect conditions that threaten the brain. Failure to investigate or even a slight delay in investigating symptoms can lead to irreversible brain injury that incapacitates the patient. Most of these occur from either a hemorrhage in the brain or a lack of oxygenated blood to the brain. Find out more about the various types of brain injury.
Advances in medicine allow high cure rates in many types of cancer, provided they are detected and treated at an early stage. Unfortunately, many cases are not diagnosed or treated until it is too late. Sometimes doctors or other medical personnel fail to order a test or investigate when presented with signs and symptoms suggesting the possibility of cancer. Other delayed diagnoses are attributable to a radiologist misinterpreting x-rays, scans, or mammograms, or to laboratory personnel who are careless when evaluating tissue specimens, Pap specimens, or other tests. And sometimes a test or film is evaluated correctly and reported to the physician, who neglects to follow up or even inform the patient about the reported abnormality.
Our Pittsburgh medical malpractice lawyers use the best pathologists and physicians to assist in the highly technical challenges of assessing the cancer misdiagnosis investigation. Together, we must establish that the diagnosis of cancer should have been done earlier and what outcome could have been expected if that had occurred. My firm has pursued cases of delayed diagnoses of bone, prostate, primary liver, gynecologic, breast, and other cancers.

Cerebral palsy and other birth injuries
The brain of a fetus or neonate can suffer many types of difficult insults. One such preventable insult is perinatal asphyxialack of sufficient oxygen delivered to the fetus in the uterus during labor. Prolonged oxygen deprivation permanently injures the brain tissues. This injury is called hypoxic-ischemic encephalopathy, and its manifestation into cerebral palsy or developmental problems may impair learning, development, and mental functions to a profound, moderate, or mild degree. In these cases, it is necessary to begin by determining when and how an asphyxic insult occurred.
One of the many indicators of fetal well-being or distress is the quality of the fetal heart rate as monitored by the obstetric team. A normal fetal heart rate with good variability during labor contractions is a 95%98% reliable indicator that the baby is healthy. During labor, changes in the fetal heart rate can indicate oxygen deprivation or the inability of the fetus to withstand the effects of the labor contractions. These cases may require immediate delivery by Cesarean section. If the obstetrical team does not recognize or appreciate the signs of fetal distress, they may not have followed acceptable practices to prevent serious brain injury or death of the baby.

Types of brain injuries
Brain injuries can occur in many different ways. Trauma can cause a brain injury. Some of these are the result of carelessness, causing direct traumatic contact to the brain by an outside object or force. Others are caused by the brain literally striking the inside of the skull.
Closed head injury
Closed head injuries can result in hydrocephalusfluid collection, hemorrhagebleeding of the tissues, and sometimes herniation of the brainthe destructive movement of the brain from the force of the fluid or blood collection.
Concussion
The brain may be injured very seriously without a fluid or blood collection. A serious concussion or bruise of the brain can injure its connecting fibers and hamper its ability to transmit signals. This can cause cognitive changes including loss or deterioration of memory, difficulty in thinking and reasoning, and speech and learning disabilities.
Anoxia and hypoxia
A problem with breathing as the result of an arrest, shock, stroke, or deficiency in the lungwhereby blood is not oxygenated sufficientlycan cause temporary anoxia (lack of oxygen) or persistent hypoxia (lowered amount of oxygen in the brain). These conditions damage brain tissue and result in severe motor and mental function deficits.
