Car Accident Liability Laws in New York eHow

No one wants to get into a serious car accident, but if you do have an accident in New York, knowing the liability laws in that state is essential. These laws determine who is at fault, who pays for damages, and how much that might cost.

    • Under New York liability law, the rule of pure comparative negligence is followed. If one party is found to be 60 percent at fault for the crash and the other party 40 percent, their damages and awards are paid out according to those percentages.

    • In the majority of cases, the car's owner is responsible for any accidents that result from use of the vehicle, even if someone else was driving at the time. As long the owner gave consent for that person to use the car, the owner's liability is the same as if he had been driving.

    • Exceptions can exist to the driver's liability for an accident if the vehicle was being driven for work at the time. In these cases, the employer might bear all or part of the legal responsibility for the crash; it is presumed that the accident would not have happened had the driver been using the vehicle for work-related purposes.
