GM Ignition Switch Recall Update - Bloomberg News is reporting General Motors filed 2,004 reports on injuries and deaths stemming from accidents in cars that have been recalled for ignition-related defects, the Center for Auto Safety said.

(Los Angeles Times) -- 4 Killed, Dozens Injured in California Bus Crash - Four people were killed and dozens hospitalized after a charter bus headed west on Interstate 10 near Blythe crashed and overturned early Wednesday when the driver tried to avoid steel pipes that were strewn on the highway from a jackknifed big rig, the California Highway Patrol said.

Media reports listed the total injured between 21 and 28 people, with six airlifted to hospitals. The bus belonged to El Paso Los Angeles Limousine Express Inc., a low-cost charter service that shuttles passengers between major cities across the Southwest. The bus had left El Paso and made a stop in Phoenix before continuing toward Los Angeles on Wednesday morning, California Highway Patrol officials told NBC Los Angeles.

(AP) -- 12 Hurt, 3 Critical in California School Bus Crash - A fast-moving school bus carrying middle school students jumped a curb, plowed into trees and a lamp post, and came to rest tilting sideways, leaving 12 people injured, three of them critically, authorities said.

"I don't see any skid marks," CHP spokesman Florentino Olivera told the Los Angeles Times. "It looks like he went straight into the tree." The bus was taking students home from an after-school activity at El Rancho Charter Middle School in Anaheim when it crashed next to Anaheim Hills Golf Course, said a statement from Michael L. In order to file a cold report for a minor traffic accident, one of the following situations must apply: 

CSPD was on Accident Alert  The Wreck was on Private Property  There was less than $1000 in total damages to all involved vehicles

  • There was no drugs or alcohol involved, and;
  • The wreck did not damage public property (e.g., a road sign, utility pole, etc.), and;
  • All drivers in the accident are still there and everyone agrees to and has vehicle and insurance information to exchange.

The woman and her son were just sitting at the corner waiting to turn onto State Road 60 when the semi took the corner too fast, flipping the trailer onto the pickup truck. The 2004 Chevrolet pickup was completely crushed.

VENTURA, CA A semi truck hit two female bicyclists participating in the 2010 Cool Breeze bicycle ride Saturday. The rear, right section of the trailer struck one of the cyclists causing her to hit the other. The two riders, both from Gilbert, AZ, were taken to Ventura County Medical Center, one by rescue helicopter. One woman had a broken leg and the other one sustained a head injury and a broken wrist and hand.

One person was killed when a semi failed to slow down and rear ended a car on I-94 and Park Road near Coloma, Berrien County, Michigan. Michigan State Police said a car was heading east bound when it slowed for traffic; but the semi truck behind the car did not slow and the car was hit from behind. The semi and car rolled over, killing Fred Reinhardt Jr., 68, of Bangor.

A motorcyclist was killed in a crash with a semi truck on Highway 16 at Hustisford Road, in Jefferson County, Wisconsin. The semi was westbound on Highway 16. He did a U-turn in front of a westbound motorcycle causing the crash. The motorcyclist, Craig R. Conway, 57, was pronounced dead at the scene by Jefferson County Coroner's Office.

Camper Trailer Hit by Semi in Summit County, Colorado
A semi truck hit a Ford Explorer pulling a camper trailer that was westbound on Interstate 70 near the Eisenhower Tunnel. The impact caused the vehicle and camper to rollover two times. John and Nancy Newman had to be removed from their vehicle with the Jaws of Life.

A semi hit a car Wednesday morning northwest of Lake Mills, Iowa. The semi - car accident happened at the intersection of 480th Street and 130th Avenue. Mercy Life Flight was called to the accident. The Winnebago County Sheriff's Office confirms that one person was killed in the crash. The accident is still under investigation.

It is estimated that 500 to 600 people are killed in farm tractor accidents each year in the United States, and for every person killed there are at least 40 others injured. According to the U.S. Department of Labor, farm tractor accidents cause more fatalities than any other type of accident on the farm. Several factors contribute to farm tractor accidents, including the amount of time the tractor is in use, the variety of uses, and the tractors power and substantial weight.

Tractor rollovers account for the majority of farm tractor accidents, but they are not the only danger riders face. Farm tractor accidents can take several different forms, such as falls, run over accidents, hitching accidents, and entanglement. Injuries resulting from farm tractor accidents include broken bones, head injuries, crush injuries, amputation, and, in severe cases, death.

Falls can involve both tractor drivers and extra riders (most often children) and can be caused by one small bump or hole in the ground. In many cases, fall victims are crushed under the wheels of the tractor or the trailing equipment. Hitching farm tractor accidents occur when the operator becomes caught between the tractor and the implement it is towing. Another cause of farm tractor accidents is entanglement. Loose clothing, shoelaces, hair, and limbs can become entangled in the tractors moving parts and cause serious injury or death. Many entanglements involve rotating power-takeoff components (PTO), which transfer power from the tractor to the implement. Because the PTO rotates so rapidly (16.6 times per second), unguarded shafts can catch loose clothing, hair, or limbs before the victim even has a chance to react. PTO farm tractor accidents usually involve the victim being drawn into the tractor or implement, causing broken bones, deep lacerations, amputation, or death. Designers, manufacturers, and suppliers of PTOs must ensure the PTO shaft is properly guarded to prevent serious farm tractor accidents from occurring. They must also provide complete and clear instructions to consumers and warnings for safe operation and maintenance.

Tractor Rollovers

Mr. Gehlhausen is a tractor rollover attorney who has represented families of persons who have been injured or killed in tractor rollovers. Tractor rollovers are the most common farm accidents to result in serious injury or death. In fact, according to the National Safety Council, tractor rollovers cause 52 percent of all fatal farm accidents. Tractor rollovers can occur in so many different ways that no one can name them all. But regardless of how they happen, there is no doubt they occur and will continue to occur until the law of gravity is repealed. In many tractor rollovers, victims suffer serious crush injuries to the head, chest, and pelvis because they become pinned under the weight of the tractor.

To prevent serious injury and death that is associated with tractor rollovers, all off road riding power machinery should be equipped with rollover protection structures (ROPS) consisting of roll bars and seat belts. ROPS are designed to protect drivers in the event of tractor rollovers by taking the full impact of the machine when it rolls. Although ROPS cannot prevent tractor rollovers, they can protect the driver from serious injury or death. In fact, according to the National Ag Safety Database, the use of ROPS and a seat belt is estimated to be 99 percent effective in preventing death or serious injury in the event of tractor rollovers.

Roll bars and seat belts have been available for tractors since the mid-1950s. Installing ROPS can lessen the risk of serious injury during tractor rollovers. If tractor manufacturers had installed ROPS on their tractors from the 1950s or 60s as standard equipment, the appalling toll of lives taken each year in inevitable tractor rollovers would not occur. Despite the number of incidents resulting in deaths and the lack of ROPS on the equipment, no major tractor manufacturer has undertaken a product recall at least on zero-turning radius equipment (ZTR). A program has been announced by one lawn mower manufacturer to install ROPS on its ZTR lawn tractors without ROPS. Skid Steer Loader Accidents

Skid steer loaders are useful on the farm and construction sites because they can haul an assortment of materials and fit into hard-to-reach spaces. Despite the machines compact size, skid steer loader accidents have the potential to cause serious injury and death. This is especially true because of the responsiveness of the controls. These machines are very unforgiving because of foreseeable errors with the controls.

How do I Obtain a Copy of an Accident Report that was Investigated by the Colorado State Patrol?

If you would like to obtain a copy of your accident report, the following information is needed:

Name of the Driver
Exact Date of the Accident
Case Report Number
Location of the Accident, Including the County

Contact the Colorado State Patrol for associated costs. Payment must be made by check or money order made out to the Colorado State Patrol. Mail the above information, along with a self-addressed, stamped envelope, and payment to the Colorado State Patrol office where the accident occurred. For Colorado State Patrol office locations, click here.

Please note, generally, the accident report will be sufficient for your needs. There is an additional charge if you require copies of the entire file. In most cases additional information (this includes witness & driver statements, including your own) may only be released through the District Attorney's Office or by filing a motion for discovery to the County Court. Once an accident investigation is complete, the entire process (submittal, review, corrections, and approval) may take up to ten (10) working days. Your copy of the report will be mailed to you as soon as possible after your request and payment have been received.

How Long do I have to Report an Accident?

Accidents are required by law, under CRS 42-4-1601 to be reported to the agency having jurisdiction immediately.

What does "Accident Alert" mean?

"ACCIDENT ALERT" is defined as those times when weather conditions are so severe that State Troopers and Police Officers are unable to respond to the large volume of motor vehicle crashes. Accident Alert is initiated on a jurisdictional and geographical basis, in other words some cities may be on accident alert whereas others may not depending on how the weather conditions are affecting their area.

While accident alert is in effect, Troopers and or Police Officers will only respond if the following circumstances exist:

  • Vehicles are disabled due to damage.
  • Accident involves a fatality or an injury requiring medical attention.
  • Alcohol or drugs are involved.
  • Accident is an alleged hit and run.
  • There is damage to public property other than wildlife, i.e. a highway stop sign.
  • Any property damage accident in which the reporting party is not or has no contact with the driver(s).

Most car radio stations report which areas are on accident alert. If you are involved in an accident and are not sure if your area is on accident alert, call the police.

If the accident does not meet the criteria for a police response, do the following:

  • The drivers involved are required to exchange information.
  • File your accident report as soon as possible.

A report can be filed either on-line or at the troop office or police station having jurisdiction where the accident occurred.

When and What do I Need to Report to my Insurance Company?

If you supplied the trooper with current insurance after the accident you will not be required to fill out a financial responsibility form. If you did not supply the trooper with current insurance you will need to fill out a financial responsibility form within ten (10) days of the accident. Notify your insurace company/agent regardless if you received a citation or another party in the accident received a citation. If you have an occupied child restraint seat in your vehicle at the time of the accident, please notify your insurance company for possible replacement. The seat could have been damaged during the accident, which would jeopardize the future safety of your child.

How do I Find Out Where my Vehicle was Towed After the Accident?

If your vehicle was towed from the accident scene and the Colorado State Patrol called the tow truck, you should have received a Colorado State Patrol Case Report form with the tow company's information on it. If you did not receive the Case Report form at the scene, it will be mailed to you at the trooper's earliest opportunity. This form will also contain the case report number in the upper right hand corner. If you require further information, please contact the trooper who investigated the accident.

To recover any personal items that may have been in your vehicle at the time that it was towed, please contact the tow company. If your vehicle has a hold placed on it for some investigatory reason, please contact the trooper that is investigating the accident for the release procedures.

COLORADO CAR ACCIDENT ATTORNEY: Proving Fault in a Car

Proving fault in a car accident boils down to figuring who acted carelessly or was negligent.

Sometimes, its clearly definable who was at fault another driver, pedestrian or cyclists negligence caused the car accident to happen. Common sense will tell you who is at fault even when you dont know the specific driving laws in Colorado the negligent person violated. Understanding who is at fault in a car accident and finding official support for your case will make negotiating with your insurance company or claiming a personal injury much easier.

Below are three general steps you can use to determine who is at fault in a car accident in Colorado and around the U.S.

1. No-Doubt Liability in Car Accidents

Some types of car accidents are pretty easy to conclude who is responsible, or at fault. Nearly 100% of the time, insurance companies will not argue who was at fault for the car accident.

I. Rear-end collisions

Regardless of why youre stopped, if youre hit from behind, its extremely rare you would be at fault. One of the basic rules of driving is that you should always be able to stop safely if traffic is stopped ahead.  Its possible for a driver who struck you to have a claim against someone who made you stop abruptly, but they are still responsible for hitting you.

Location of the damage on the vehicles provides proof of a rear-end collision if the back of one vehicle is damaged along with the front of the other, a rear-end collision occurred.

In a few instances, you can be held partially responsible for a rear-end collision, reducing your compensation. Having one or both rear-brake lights out at night or experiencing mechanical problems but failing to do all you can do to move the vehicle off the roadway are a couple examples of exceptions to this no-doubt liability rule in determining fault for a car accident.

II. Left-turn car accidents

In nearly every case involving a car going straight down the road and a car making a left turn, the car making the left turn is deemed at fault if an accident occurs.

The same concept as in rear-end collisions applies - where the damage is located is key to identifying a left-turn accident with your insurance company or in any Colorado personal injury claim. If there is damage on the front-end of one car and on the front-right side of the other, a left-turn accident has occurred.

Exceptions to the no fault provision of a left-turn car accident include when the car traveling straight was traveling way over the speed limit or ran a red light.

2. Police reports

Another way to prove fault in a car accident is by obtaining any police reports filed by the officers responding to the accident. If its obviously clear who was at fault, the officer may state his opinion that someone violated a specific traffic law, causing the car accident.

In fact, any mention in the police report of a traffic law violation or careless driving by another driver is good proof that they were at fault for the car accident.

3. State and local traffic laws

Research state and local laws to find additional support for any negotiation with your insurance company or personal injury claim.

You can access a basic outline of Colorados driving regulations here or visit your local department of motor vehicles office. Look for instances involving your car accident in the index speed limits, right of way, roadway markings are just a few examples.

Most public libraries have copies of the actual driving statutes or you can visit a law library to find driving statutes in your state. If you think a rule may apply to your car accident, write it down exactly as it appears along with the statute number.

There also may be local statutes that apply to your case. Visit the website for the city/county where the accident occurred to learn about any local ordinances that may have been violated by the other driver.
